Service Provider

Scope

These Terms of Service govern all purchases made through atelierderman.com. By placing an order with us, you agree to these Terms. We reserve the right to amend these Terms at any time; the version published on this page at the time of your order shall apply.

Platform and Hosting

Our store is operated on the Shopify platform. Shopify hosts the store and processes data necessary to provide it. Shopify also operates features that use data from your interactions with our store together with data from other Shopify merchants, in order to improve Shopify's products, security, ad targeting and personalisation. That processing is governed by Shopify's Additional Services Terms and by Shopify's own privacy policy. Further detail is set out in our Privacy Policy.

Products

Atelier Derman offers made-to-order photographic prints, available in Solo, Duo, and Trio configurations. Each piece is produced individually following your order, using the materials and frame options described on the relevant product page. Product images are for illustrative purposes; minor variations in tone, framing, and finish may occur due to material characteristics, differences between screens and printed output, and individual assembly.

Prices and VAT

All prices displayed on our website are stated in Euro. In accordance with § 19 UStG (German Value Added Tax Act), Atelier Derman qualifies as a small business (Kleinunternehmer) and therefore does not charge value added tax (VAT). Prices shown do not include a separate VAT statement for this reason. Shipping costs, where applicable, are shown separately during checkout before you complete your order.

Order Process and Contract Formation

The presentation of products on our website does not constitute a binding offer on our part, but an invitation for you to place an order. By completing the checkout process and clicking the order button, you submit a binding offer to purchase the selected items. We accept your offer by sending you an order confirmation by email immediately after your order has been placed. The contract is concluded upon receipt of this order confirmation.

Ordering steps: you select the desired work and options on the product page and add it to your cart. In the cart and at checkout you can review and change the selected items, quantities and your contact, delivery and billing details at any time before you submit your order, using the editing options provided there. You complete the ordering process by clicking the final payment button, which submits your binding order to us.

Contract language and storage: the contract can be concluded in English or German. We store the order data; you receive your order details by email with the order confirmation and can view your past orders at any time through your customer account. We recommend that you save or print these Terms before ordering.

Payment

Payment is due at the time of ordering, using one of the payment methods offered at checkout. Your order will only be processed for production once payment has been successfully received.

Shipping and Delivery

As each piece is made to order, production and delivery times are provided on the relevant product page and at checkout. We ship within Germany and to select destinations within the European Union; specific shipping options and costs are shown during checkout.

Risk of accidental loss or damage to the goods passes to you upon delivery of the goods to you or to a third party designated by you, other than the carrier, in accordance with statutory consumer protection provisions.

Right of Withdrawal

As a consumer, you generally have a statutory right to withdraw from your purchase within fourteen days. Standard Atelier Derman collections remain covered even though they are made to order. The statutory exception may apply to personalised or bespoke goods made to your individual specifications or clearly tailored to your personal needs.

Retention of Title

The delivered goods remain our property until payment has been received in full.

Warranty for Defects

We are liable for defects in accordance with the applicable statutory provisions, in particular §§ 434 et seq. of the German Civil Code (BGB).

If goods are defective or otherwise not in conformity with the contract, you may be entitled to repair or replacement in accordance with applicable law. Atelier Derman bears the necessary costs of such remedy, including applicable transport costs.

Where the statutory requirements are met, further remedies may include a reduction in price or withdrawal from the contract and reimbursement of the purchase price.

Intellectual Property

Content on this website, including photographs, text, layout, and design, is owned by or licensed to Atelier Derman and, to the extent protected by applicable law, is protected by copyright and other intellectual property laws. Reproduction, distribution, or other use of protected content without the relevant permission is not permitted.

Applicable Law and Jurisdiction

These Terms and any contract concluded through our website are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Where you are a consumer, this choice of law does not deprive you of the protection afforded by any mandatory provisions of the law of the country in which you have your habitual residence.

Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Creative Process

Some works may incorporate artificial intelligence as one of several creative tools used in preparing our collections. Every artwork remains conceived, creatively directed, selected, refined and approved by Atelier Derman.

Intellectual Property, AI Training & Commercial Use

Unless expressly authorised in writing by Atelier Derman, protected artwork, photographs, images, text, design, branding, or layout made available by Atelier Derman may not be copied, reproduced, scraped, downloaded, or used for artificial intelligence training, machine learning, dataset creation, model fine-tuning, or any similar purpose, except where such use is permitted by applicable law.

Purchasing an artwork grants ownership of the physical object only and does not transfer copyright or any right to reproduce, modify, distribute, create derivative works from, or commercially exploit the artwork.
